This Guideline sets out the legislative regime that governs Carriers' powers to inspect land and install or maintain facilities under the Telecommunications Act 1997. The Guideline sets out the applicable provisions in the legislation that define the source and scope of Carrier's powers which have the potential to lead to interaction with land owned by NSW LWUs. It outlines the responsibilities of Carriers under the Telecommunications Code of Practice and Schedule 3 to the Telecommunications Act 1997, and the process to be followed where there is a breach of those provisions. It outlines the process of objecting to a Carrier's proposed activity, and the remedies available in dealing with a breach of the Telecommunications Act 1997. The Guideline also addresses questions raised by LWU members through case studies. These case studies are adapted from the past experiences of LWUs, and are intended to provide general guidance to LWUs on the application of the principles detailed in this Guideline.
