Hello all,Since commencing fluoridation in 2012 Port Macquarie-Hastings Council has experienced resistance from a small but vocal section of the community. Recently, Council has been approached by members of the community in regards to the Federal Circuit Court case of Lusk v. Tong which sets out to establish that fluoridated water is a Therapeutic Good and therefore the addition of fluoride to water is illegal. Our Councillors are currently considering this matter and have requested further information. I was wondering if any other Councils (that fluoridate) are aware of this issue or have been similarly approached and what your Councils position on this matter may be? Does the Water Directorate itself have a position on this issue? Any feedback appreciated.Clayton Miechel

Hi Clayton, The NSW Water Directorate has been advised to refer these these types of community flouridation issues to NSW Health Department. NSW Water Directorate supports NSW Health to provide safe and reliable drinking water and supports NSW Health's policies as one our our industry's regulators. Please have a chat to Josh Tickell (Senior Project Officer - Water Unit, NSW Health on 9391 9030/0477 746 868, josh.tickell@doh.health.gov.au) or Sandy Leask (Senior Policy Advisor - Water Unity, Environmental Health Branch, NSW Health on 9391 9893/0402 703 928, aleas@doh.health.nsw.gov.au). These guys have specifically offered to provide support to LG LWUs in these types of matters.Cheers,Jason Ip, Manager Operations - Riverina Water County Council (6922 0658 / jip@rwcc.nsw.gov.au)

Hi Clayton.I recommend that you contact NSW dept of Health (DOH) and explain the situation. There is a resistance to fluoride dosing in drinking water however this can be resolved with information sessions and education that DOH has offered when there were a few queries on our side. Fluoride dosing is an health requirement and is strictly managed - refer to NSW code of practice for Fluoridation of Public Water Supplies for more details.RegardsIrene Chetty

Hi Clayton,NSW Health's Water Unit in Sydney would be happy to assist you with a range of resources - Dr Paul Byleveld, Sandy Leask, Josh Tickell. A good example is the help they gave Gunnedah last year , link to report below, you might need to cut and paste this into your web browser. The report includes reference to Michael Lusk.Regards,Brendan Guiney, Director Water Services, MidCoast Councilbrendan.guiney@midcoast.nsw.gov.au02 6591 7503http://www.gunnedah.nsw.gov.au/index.php/component/rsfiles/preview?path=GunnedahShireCouncil%252FCOUNCIL%252FCOUNCIL-INFORMATION%252FCouncil-Committee-Meetings%252FCouncil-Meetings%252FCouncil-Meeting-Agendas%252F2017%252FDecember%2BBusiness%2BPaper%2B-%2B20%2BDecember%2B2017%2B-%2BAttachment%2B1%2B-%2BFluoridation%2Bof%2BGunnedah%2BWater%2BSupply.pdfLink to NSW Health fluoridation info page:http://www.health.nsw.gov.au/environment/water/Pages/fluoridation.aspx
